We, as LetMeRepair Benelux BV, are pleased that you are interested in our company, services and services. We feel it is important to protect your personal data that you have submitted to us. In this privacy statement, we explain how we collect, use and protect your personal data. We also explain what rights you have in relation to your personal data and how you can exercise those rights.

 

2. What is personal data

Personal data means any information relating to an identified or identifiable natural person ('data subject'). An identifiable natural person is someone who can be identified, directly or indirectly, in particular by means of identifiers such as a name, identification number, location data, an online identifier or one or more factors characterising that natural person's physical, physiological, genetic, mental, economic, cultural or social identity. This includes information such as your actual name, address, telephone number and date of birth. Information that cannot be linked to your actual identity - such as favourite websites or the number of users of a site - is not considered personal data.

4. Personal data we process

We process your personal data because you have provided us with your data to enter into a service agreement with us, or we have received your personal data from third parties to provide service and support for the products of one of our customers/manufacturers. In addition, you may have provided us with your personal data to customise our service and services to your preferences and interests.

 

We process the following personal data:

- Name and address

- Contact details (e-mail, telephone number)

- Company name

- Company address

- Payment information (optional)

 

When you use our services/services, depending on the use you make of the product or services, we additionally process the following data that may be considered personal data:

1.         Technical information, including the internet protocol (IP) address used to connect your device to the internet.

2.         Your browser type and version, time zone, browser plug-in type and versions.

3.         The operating system and platform.

4.         Information about your visit, including the Uniform Resource Locators (url) click path to, through and from our site.

 

Technical information

To ensure that every visitor to one of our websites is able to search and use that site effectively, we use tracking software to determine how many users visit our website and how often. We do not use this software to collect personal data or individual IP addresses. The data is only used in anonymous and/or abbreviated form.

5. Legal basis for the processing of personal data

The processing of personal data is based on the following bases, as defined in Article 6 of the General Data Protection Regulation (AVG) / General Data Protection Regulation (GDPR):

4.         Vital interests of a data subject or other natural person

5.         Legitimate interests of LetMeRepair Benelux BV or third parties.

Justified interests are for example: marketing, security, IT management, improvement of products, legal procedures, internal company processes.

 

6. Purposes of processing personal data

We collect your personal data for one or more of the purposes listed below. The numbers after each purpose refer to the legal basis mentioned above (Article 5).

7. Storage of personal data

We store personal data in accordance with our own data retention policy, taking into account specific legal requirements, e.g. tax regulations. This means, among other things, that your data is stored on servers only within Europe.

 

8. Sharing data with third parties

Your personal data are not shared, sold, transferred or otherwise passed on by us to third parties now or in the future, unless this is required by law or necessary for the purpose of the agreement, to provide you with services or unless you have given your explicit consent. For example, when you place an order or have requested a service, we may need to pass on your address and the details of your order to our contractors (e.g. a self-employed person who carries out repairs for us at your home).

 

Our business partners are bound by their privacy policies. We recommend that you review their privacy policies prior to the transaction. In particular, payments are covered by the payment processor's privacy policy.

 

External service providers who process data on our behalf are contractually bound to strict confidentiality, in accordance with Art. 28 AVG.

We may share your personal data within the LetMeRepair group for the performance of a contract with you, to provide services or because of a legitimate interest of LetMeRepair Benelux BV (e.g. for centralised customer service administration).

 

We may, if necessary, use and process your personal data anywhere within Europe for the purposes set out in this statement. Your data will not be shared outside the countries covered by the scope of the General Data Protection Regulation.

 

9. Security measures

We take all necessary technical and organisational security measures to protect your personal data. Your data is stored in a secure working environment that is not accessible to the public. Where possible, we use encryption to secure the transmission of personal information. However, please note that although we take all reasonable steps to protect your information, no website, transmission over the internet, computer system or wireless connection is completely secure. In the unfortunate event that your personal information is compromised, we will notify you as soon as reasonably possible under the circumstances.

 

10. Your rights as a data subject

As a data subject, you have certain rights in relation to the personal information we hold about you. To exercise these rights, please contact privacy@benq.eu by email or use the details in the "Contact Us" section below, requesting to exercise your right. You have the following rights:

 

Right of access

You may ask to see the personal data we hold about you free of charge. Should exceptional circumstances arise where we refuse to provide information, we will explain them. We reserve the right to refuse light-hearted or offensive requests. If responding to requests may require additional time or incur unreasonable costs that may be payable by you, we will inform you accordingly.

 

Right to rectification

If you believe that we have inaccurate or incomplete personal information about you, you may request that we correct or supplement that information. This right may be used in conjunction with restriction of processing to ensure that inaccurate/incomplete information is not processed before it is corrected.

 

Right to erasure (the "right to be forgotten")

When there is no longer a compelling legal basis or legitimate reason for processing personal data, you may request us to erase the personal data. We will take all reasonably possible steps to ensure erasure. Please note: If there has been a service or service we have provided, even if it has taken place at no cost to you, we may not erase your data but are obliged to retain your data under higher law.

 

Right to restriction of processing

You can ask us to stop processing your personal data. We will then still have the data, but will not process it further. This right is an alternative to the right to erasure. You can exercise your right to restrict processing when any of the following circumstances apply:

1. the accuracy of the personal data is disputed,

2. the processing of personal data is unlawful,

3. the personal data is no longer needed for processing but is needed as part of legal proceedings,

4. the right to object has been exercised and processing is restricted pending a decision on the status of processing.

 

Right to data transfer

You can ask for a copy of the personal data that LetMeRepair Benelux processes. We transfer the personal data in a commonly used and machine-readable format. This concerns personal data that we have processed on the basis of your consent or for the fulfilment of a contractual obligation towards you.

 

Right to object

You have the right to object to processing of your data by us when:

- processing is based on a legitimate interest;

- the purpose of processing is direct marketing;

- processing involves automated decision-making and profiling.

           

Identification

We may ask you to identify yourself with every request you make. This is to establish who you are so that your personal data cannot be shared with other individuals, and to ensure that any changes to the data are made to the correct records.

 

Withdrawing your consent

You may withdraw your consent to the processing of your personal data at any time. If you wish to withdraw your consent, please let us know via one of the communication channels. We will then no longer process your personal data. This only applies to personal data processed with your consent.

Deadlines

We will respond to your requests as soon as possible, but no later than one month. If we do not meet this deadline, we will notify you before the deadline expires. The response period may take up to three months due to the complexity or size of your requests.

12. Changes to the privacy statement

We do our utmost to keep this privacy statement as accurate and correct as possible. It may therefore be necessary to amend our statement.

LetMeRepair Benelux BV reserves the right to make changes at any time and without prior notice. Therefore, please check regularly for changes.

Should you not be satisfied with the way we handle your data, or with the handling of a complaint from you about our handling of your data, you have the right to submit your complaint to a supervisory authority within the European Union.
